Solving Your Immigration Issue Is Our Top Priority

Asylum Lawyers: Navigating Complex Cases With Dedication

In the complex world of immigration law, asylum cases stand out as particularly challenging. Nationwide, only 33% of asylum applications are granted. At Borjas Law Group, LLC., our asylum lawyers have an 80% approval rate for our clients. This rate represents lives changed, families reunited and futures secured.

Our experience and dedication have made a significant difference for many asylum seekers. Every case is important to us, and we give each one our full attention. We’ll work hard to help you build a strong case.

We Welcome Asylum Seekers From Anywhere In The World

At our firm, we speak your language – literally and figuratively. Our attorneys, including Xavier Borjas, Nestor Vicario and Alberto Gonzales, are fluent in Spanish and Tagalog. We also have a network of professional translators ready to help in just about any language.

So whether you’re from South America, Asia or anywhere else in the world, we can provide the compassionate representation you need as an asylum seeker.

Compassionate Guidance Through The Asylum Application

Many clients ask, “How do I apply for asylum?” The process can seem scary, but we’re here to guide you every step of the way. In Chicago and throughout Illinois, you can file for either affirmative or defensive asylum.

Affirmative asylum is for those who are not in removal proceedings. You must file Form I-589 within one year of arriving in the U.S. We’ll help you gather the necessary documentation and prepare a compelling case.

Defensive asylum is for those who are in removal proceedings. In this case, asylum serves as a defense against deportation. The process involves presenting your case before an immigration judge.

Regardless of which type applies to you, our experienced asylum lawyers will be by your side, ensuring your application is thorough and persuasive.

Grounds For Asylum Seekers

To be granted asylum, you must demonstrate a well-founded fear of persecution in your home country based on one or more of these grounds:

  • Race: Persecution based on your racial identity or ethnic background. This includes discrimination, violence or threats due to your skin color, ancestry or ethnic group—for example, a person of Rohingya ethnicity facing persecution in Myanmar.
  • Religion: Discrimination or threats due to your religious beliefs or practices. This can involve being punished for practicing your faith, forced to practice a different religion or persecuted for converting to another religion. An example would be a Christian facing persecution in a country where Christianity is outlawed.
  • Nationality: Targeting based on your country of origin or citizenship. This might involve persecution due to your national origin, even if you’re a minority in your home country. For instance, a person of Indian origin facing discrimination in Uganda.
  • Political opinion: Persecution for expressing or holding certain political views. This includes being targeted for supporting a particular political party, criticizing the government or advocating for human rights. An example could be a journalist facing threats for writing articles critical of the government.
  • Membership in a particular social group: Threats due to your association with a specific group that shares common, immutable characteristics. This can include LGBTQ+ individuals, women fleeing domestic violence or members of a particular clan or tribe. For example, a gay man facing violence in a country where homosexuality is criminalized.

Our team of skilled asylum attorneys in Chicago will work closely with you to identify the strongest grounds for your case. We’ll help you gather compelling evidence to support your claim based on the most relevant grounds for your situation.

What To Expect During An Asylum Interview

The asylum interview is an important part of the process; many clients are understandably nervous about it. Here’s what you can typically expect:

  • The interview usually lasts one to two hours
  • An asylum officer will ask detailed questions about your application and your fear of returning to your home country
  • You’ll need to provide specific examples of persecution or threats you’ve faced
  • You can bring an attorney with you for support and guidance

Our experienced asylum lawyers will thoroughly prepare you for this interview, helping you feel confident and ready to tell your story.
