How Does Consular Processing Work?
The steps of consular processing are similar to those for an Adjustment of Status. Your first step is to determine your basis for immigration. Most immigrants’ eligibility is through a family-based or an employment-based immigration petition made on their behalf by a sponsor. Other eligibility classes exist, however, such as for refugees, victims of human trafficking, those seeking asylum, and other special categories. You may or may not need a sponsor depending on the circumstances.
Your immigration petition will be filed with a U.S. Citizenship and Immigration Services (USCIS) field office, embassy, or consulate abroad. Once it is approved there, it will be forwarded to the National Visa Center (NVC). If it is approved by the NVC, you will be contacted.
From there you will have to:
- Complete an interview with a USCIS official
- Gather and submit financial documents
- Undergo certain medical exams
- Pay application fees
